“SDC T-Shirt Design Contest” Challenge – Official Rules

THIS IS A PROMOTIONAL CONTEST. NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. THE PROMOTION IS VOID WHERE PROHIBITED OR RESTRICTED BY APPLICABLE LAW, AND ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS APPLY. Winners are responsible for any taxes, customs, duties, costs, expenses and similar amounts connected with entering the Contest and accepting any Prizes.

1. Overview of Contest

The “SDC T-Shirt Design” (“Contest”) is sponsored and administered by Samsung Electronics America, Inc. (“Sponsor”). To enter, submit an original t-shirt design (see design parameters below) (“T-Shirt Design”) to hello-dev@samsungdevelopers.com during the Submission Period (defined below). All eligible entries will be posted on Sponsor’s official Facebook page, www.facebook.com/samsungdev, during the Voting Period (defined below). Five (5) entries will be selected for a shortlist based on number of likes received on Facebook during the Voting Period. Then, a panel of judges will select one Grand Prize winner and two Runner-Up winners based on criteria set forth in these Official Rules. The Grand Prize winner will receive travel and hotel accommodations to SDC2017, and two SDC2017 passes, and the Runner-Ups will each receive a Samsung swag bag (collectively, the “Prizes”).

2. Contest Period

Submission period begins on June 28, 2017, at 9:00 AM PST and ends on August 10, 2017, at 10:00 AM PST (“Submission Period”). Voting on Facebook begins on August 11 and ends on August 24, 2017.

All times stated by Sponsor are in Pacific Daylight Time (local to California). Entries received before or after Contest Period will not be accepted or be eligible to win a Prize. Sponsor’s clock is the official clock of the Contest.

3. Eligibility

Eligibility to participate in the Contest or to win Prizes is limited to individuals who are a legal resident of Canada (excluding Quebec), or the United States (including the District of Columbia); and be at least the legal age of majority within their respective Province or State.  Participants who violate these Official Rules or disregard the decisions of Sponsor are not eligible to participate or win. Directors, officers, employees, contractors and agents (and their immediate families and household members) of the Sponsor, its parents, affiliates, subsidiaries, advertising and promotion agencies, or any other company involved with the design, production, execution or distribution of the Contest are not eligible to enter or win a Prize. The Sponsor’s determination of eligibility, in its sole discretion, shall be final.

4. How to Enter

To enter, complete the following steps:

  1. Read through the Official Rules for participation. Submitting a T-shirt design for the contest indicates that you have read the Terms and Conditions and indicates acceptance of the rules for participation.
  2. Create your T-shirt design, “unleash your your inner artist”, while keeping the following requirements in mind:
    1. The winning design will be printed on dark heather grey T-shirts
    2. Maximum design size must be 11”x11”
    3. Your design will be printed on the front chest of the T-shirts
    4. Designs must be a maximum of 4 colors; pantone color codes must be provided for each color in the design
    5. Your design(s) must be original artwork
    6. Designs should not include trademarks, logo’s or banding of any type including Samsung, SDC 2017, Developer Connection, Twitter, Facebook, Instagram etc.  Shirts will have the Samsung logo on the sleeves
    7. Design submissions must include 2 files for your design – a jpg image and an Illustrator file
    8. You can enter up to 3 designs, but only one of your designs can win
    9. Create a design that can be “experienced!” We are looking for artwork that expresses the SDC “Connected Thinking” theme. Show off your artistic creativity by using elements like graphics, visual renderings, forms, text, code, arranged type, figures, sketches, patterns, illustrations, paintings, drawings
  3. Email your design to hello-dev@samsungdevelopers.com by August 10, 2017. Two design files must be provided – a JPG file and a print-ready Illustrator file. Samsung will post all designs that meet the terms and conditions to the Facebook Contest Album at www.facebook.com/samsungdev on August 11, 2017.

Complying with Sponsor’s instructions and these Official Rules will generate one (1) entry into the Contest (an “Entry”, one t-shirt design). Any participant who submits after the Contest Period or who submits any content that is not in compliance with these Official Rules, will not be given an Entry into the Contest.

5. T-Shirt Design Requirements

T-Shirt designs must be your own original creation for this Contest, and only t-shirt designs that are appropriate, in good taste and meet the requirements and restrictions set forth below will be eligible.

T-Shirts MUST NOT:

  • Copy, imitate, modify, enhance or alter a pre-existing work, or contain material that violates or infringes another’s rights, including privacy, publicity or personality rights, and copyright, trademark or other intellectual property rights; this includes Samsung and SDC logos.
  • Disparage Sponsor or any other party affiliated with the Contest or contain material that promotes bigotry, racism, hate or harm against any group or individual or that is discriminatory or offensive;
  • Contain, reference or allude to brand names or trademarks other than those that belong to Sponsor, which participant has a limited license to use solely to incorporate in the Video in this Contest and for no other purpose;
  • Contain any material that is libelous, defamatory, sexually explicit, obscene, vulgar, threatening, abusive, pornographic, hateful, or is otherwise objectionable;
  • Contain material that is unlawful, in violation of, or contrary to governing laws or regulations;
  • Include minors;
  • Include private information that is not intended to become public;
  • Include anyone else or anyone else’s personal information without his/her (prior written consent for Sponsor to use his/her image or information as set out in 6; or
  • Promote, advertise or market any product or service other than those of the Sponsor, contain any commercial content, or be intended for advertising, marketing, or any commercial use other than for Samsung Gear.

Sponsor reserves the right to reject, modify, edit, or remove your design and judge it void or disqualify it and you at any time, without notice to you, if, in the opinion of Sponsor, acting in its sole and absolute discretion, the t-shirt design does not comply with the Official Rules, or could potentially expose Sponsor to lawsuits, embarrassment, adverse publicity or otherwise reflect unfavorably on Sponsor.

6. Rights in T-Shirt Design and Publicity Rights

By submitting a T-Shirt Design, each entrant represents and warrants that his or her T-Shirt complies with Sections 4 and 5 herein, and hereby irrevocably grants Sponsor and its parents, affiliates, subsidiaries, agencies, service providers, designees, successors, assigns and licensees the unfettered and unlimited right and perpetual license to photograph, film, record, edit, alter, publish, publicly display, and otherwise use and authorize others to use his or her name and likeness (“Name and Likeness”, unless prohibited by law, and to edit, alter, publish, publicly display, produce, reproduce, perform, convert, adapt, communicate to the public, assign, sub-license, dispose of, and otherwise use and authorize others to use his or her submitted T-Shirt design, for any purpose whatsoever, including without limitation advertising and marketing, without further notice, obligation or consideration. Each entrant also waives all privacy and personality rights in his or her T-Shirt design, and waives including moral rights, it may have, in favor of Sponsor and its successors and assigns. For the avoidance of doubt, all T-Shirt Designs submitted for the Contest may be used by Sponsor and its agencies and service providers in the manner described in this Section, regardless of whether such T-Shirt design complies with the stipulations present in Sections 4 and 5. Sponsor shall have no obligation (express or implied) to use entrant’s Name and Likeness or T-Shirt design, but may do so and may edit or alter such information or materials, at Sponsor’s sole discretion, without further notice, obligation or compensation. Each entrant further agrees not to upload, download, distribute, disseminate, copy, reproduce the T-Shirt design or otherwise cause the T-Shirt design to be on any public website.

7. Judging

Phase 1: Facebook Votes

Voting will run from August 11 to August 24, 2017, so share with your network, friends and family. Facebook likes are considered votes. The top five designs with the most likes by August 24 will be shortlisted.

Phase 2: Panel of Judges

An internal panel of Samsung judges will select the grand prize winner and two runners up designs from the shortlist based on the following criteria:

  1. Creativity
  2. Innovation
  3. Support of the SDC Theme “Connected Thinking”, either using the actual words or though graphical interpretation.

Each shortlisted T-Shirt Design eligible entries received by Sponsor will be judged by Samsung Developer Team using the following judging criteria (“Judging Criteria”) ranked in order of importance and scored from 1-10, 10 being highest for a possible total of 30 points, 10 per category.

Creativity

  • How imaginative / creative are your t-shirt design(s) & graphic(s)
  • How imaginative / creative is your t-shirt?
  • How well did you utilize color or absence of color?

Innovation

  • How original is the idea?
  • How Compelling?
  • How Different?
  • How Unique?

Support of the SDC Theme “Connected Thinking”

  • Either using actual words or through graphical interpretation
  • How well overall designs incorporate the “Connected Thinking” theme in the t-shirt design

In the event of a tie, Entry with the highest score for Innovation will be selected.

The winning designs will be announced on August 25, 2017. It will be featured on the Samsung Developers Facebook page at www.facebook.com/samsungdev and on www.SDC2017.com.

8. Prizes

One (1) Grand Prize – two (2) Samsung Developer Conference 2017 (the “Event”) passes, hotel accommodations and airfare and ground transportation as follows: (i) coach class airfare to the event from within the United States (unless the Grand Prize winner lives within one hundred (100) miles of San Francisco, CA, in which case, Samsung will pay for ground transportation from the Grand Prize winner’s residence to San Francisco, CA, (ii) ground transportation to/from destination airport and hotel, and (iii) accommodations for two (2) nights at a hotel of Sponsor’s selection. Approximate value $5000 USD.

Two (2) runner up prizes – Samsung swag bag containing Samsung T-shirt, pins, stickers. Approximate value $50 USD.

Prize is nontransferable, has no cash-value, and must be accepted as awarded. No substitution may be made, except by Sponsor. Sponsor reserves the right to substitute a prize, or prize component, of equal or greater value. Any expenses, including any applicable taxes, not expressly specified as being part of the Prize are the sole responsibility of winner. If required by law, winner will be issued a 1099 tax form for the Prize value.

Each Winner is responsible for all costs and expenses associated with the acceptance and use of the prize not specified herein as being awarded, including, but not limited to, all federal, state and local taxes, luggage fees, additional ground transportation, meals, gratuities and souvenirs. All prize details are at the sole discretion of the Sponsor. If, for whatever reason, the Event is cancelled or postponed, no compensation or substitution will be provided, however remainder of prize package will be awarded and Sponsor shall have no further obligation to such Grand Prize Winner. Travel must be made through Sponsor’s agent, on a carrier of Sponsor’s choice. Travel is subject to capacity controls, availability, and certain other restrictions, all of which are subject to change. No stopovers are permitted on tickets issued as a prize; if a stopover occurs, the prize will terminate at the stopover point and full fare will be charged for the remaining segments, including the return, of the trip. The Sponsor is not liable for any expenses incurred as a consequence of a flight cancellation or flight delay. Grand Prize Winner must execute and return a travel liability/publicity release prior to travel. Grand Prize Winner is responsible for obtaining all travel documents required by airline and comply with all applicable hotel check-in requirements, such as presentation of a major credit card. Grand Prize Winner must comply with all applicable Event rules and regulations. Sponsor reserves the right to deny participation or remove Grand Prize Winner from Event if he/she engages in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the Event, or appears to be under the influence of drugs or alcohol. Sponsor may change the date or venue of the Event in its sole discretion.

10. Prize Disclaimer

Prize is provided by Sponsor on an “as is” basis with no warranty of any kind. SPONSOR DISCLAIMS ALL GUARANTEES, WARRANTIES, REPRESENTATIONS AND CONDITIONS WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO ALL PRIZES AND THIS CONTEST.

11. Winner Confirmation

 

The potential Grand Prize winner and potential Runner Ups will be announced on Facebook and notified by email. In order to accept their Prizes, the potential Grand Prize winner and potential Runner Ups, must:

(a)     reply by email

(b)     if required by Sponsor, provide proof of identity;

(c)     be in full compliance with these Official Rules; and

(d)     execute and return to Sponsor a Declaration of Compliance with Contest Rules and a Release of Liability and Consent to Publicity Form, which includes, without limitation the selected entrant’s consent to the use of his/her name, address (city and province/territory), photograph, image and/or likeness, statements regarding the Contest or the prize and/or voice, without further notice or remuneration, in connection with any publicity carried out by or on behalf of Sponsor with respect to the Contest including social media platforms and other uses.

If the selected entrant cannot be confirmed a winner as described above, the selected entrant will be disqualified and the Sponsor will select an alternative entrant with the next highest score, and proceed with winner confirmation. The process will repeat until an entrant is confirmed a winner.

12. Entrants’ Agree to Abide by Rules and Decisions

By entering, you agree that you have read and understood the Official Rules and agree to abide by them and the decisions of Sponsor and Judges, which shall be final and binding in all matters relating to the Contest and the awarding of the Prize. You further represent and warrant that all information contained in your Entry is true and accurate.

13. Changes to Contest, Rules, etc.

Sponsor reserves the right to cancel, terminate, suspend, or modify the Contest or amend the Official Rules at any time, without prior individual notice, and for any reason. Without limiting the generality of the foregoing, if fraud or technical failures destroy the integrity of a Contest, or if a technical problem corrupts the administration of the Contest, as determined by Sponsor in its sole discretion, Sponsor may award the prize from among all eligible Entries received as of the time of cancellation in a random drawing, and Sponsor shall have no further obligation to any participant in connection with the Contest.

14. Disputes Regarding the Identity of the Entrant

In the event of a dispute as to any registration, the authorized account holder of the email address used to submit their t-shirt design will be deemed to be the participant. The “authorized account holder” is the natural person assigned an email address or other account by an Internet access provider, online service provider or other organization responsible for assigning email addresses or the account for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder of the email address associated with the winning Entry. Any effort by a participant to misrepresent himself or herself through the use of aliases or multiple email addresses will disqualify that participant.

15. Civil and Criminal Remedies Available to Sponsor

CAUTION: ANY ATTEMPT BY AN ENTRANT OR OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY EQUIPMENT, SOFTWARE OR WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SAMSUNG ENTITIES (AS DEFINED BELOW) RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW AND BAN THE ENTRANT FROM THIS CONTEST AND ANY FUTURE CONTESTS. THIS CONTEST IS INTENDED FOR PARTICIPATION IN THE US ONLY AND SHALL BE CONSTRUED ONLY ACCORDING TO US LAW.

16. Indemnification

Each participant hereby releases, and agrees to defend, indemnify and hold harmless the Sponsor and Facebook Inc. and each of their parents, subsidiaries and affiliates, agencies, service providers, those working on its behalf, and each of their respective officers, directors, representatives, employees, agents, designees, licensees, successors and assigns (the “Samsung Entities”), from any damage, injury, death, loss or other liability, either at law or equity, whether known or unknown, asserted or non-asserted, that may arise from or in any way relate to participation in this Contest, creation of the Video, or the use of the Video by Sponsor, or the awarding, acceptance, use or misuse of any Prize or any other substitute prizes.

17. Release of Liability

Samsung Entities are not responsible for any printing errors in these Official Rules, in the Entry or otherwise in any Equipment or materials available for participation in the Contest. Samsung Entities are not responsible for any human or other error that may occur in the processing of the Entries, nor are they responsible for any error, omission, interruption, deletion, defect, or delay in operation or transmission, theft or destruction or unauthorized access to or alteration of Entries, or for technical, network, telephone, computer hardware or software malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or failures of any wireless or internet service providers, traffic congestion on the Internet or at any web site or any combination thereof, which may limit a person’s ability to participate in the Contest or receive communication from Sponsor. Samsung Entities assume no responsibility for undeliverable messages resulting from filtration of an entrant’s wireless or Internet service provider or for insufficient space to receive messages.

BY PARTICIPATING IN THIS CONTEST, PARTICIPANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF PARTICIPANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO PARTICIPANT.

18. Dispute Resolution, Conflict of Laws and Jurisdiction

Any and all disputes, claims, and causes of action arising out of or in connection with this Contest shall be resolved individually, without resort to any form of class action. This Contest shall be governed by, and construed in accordance with, the laws of the State of New York, regardless of conflicts of laws principles. Any action or litigation concerning this Contest shall take place exclusively in the federal or state courts sitting in New York County, New York, and EACH PARTICIPANT EXPRESSLY CONSENTS TO THE JURISDICTION OF AND VENUE IN SUCH COURTS AND WAIVES ALL DEFENSES OF LACK OF JURISDICTION AND INCONVENIENT FORUM WITH RESPECT TO SUCH COURTS. Each participant agrees to service of process by mail or other method acceptable under the laws of the State of New York. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS CONTEST AND MUST NEVER INCLUDE CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, AND IN NO EVENT ATTORNEYS’ FEES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO PARTICIPANT.

19. Rules Govern

Contest will be run in accordance with these Official Rules and they shall prevail, govern and control in the event of any inconsistency with any Contest-related materials.

20. Privacy

Any personal information submitted by you or collected from you in connection with the Contest may be used by Sponsor and its designees in connection with the administration of this Contest, and is otherwise subject to the Privacy Policy found at http://www.samsung.com/us/common/privacy.html.

21. Sponsor

Sponsor is Samsung Electronics America, Inc., with a principal place of business at 665 Clyde Avenue, Mountain View, CA, 94043, USA. The promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.
